L’interpretazione autentica
Io trovo che la lettura del puro e semplice testo del decreto ad paninum facitum (come lo chiama Pippo Civati) varato nella notte valga quasi più di ogni possibile commento.
Per esempio, mi pare fantastico che “… In particolare, la regolarità dell’autenticazione delle firme non è comunque inficiata dalla presenza di un’irregolarità meramente formale …” (art.1, comma 2, i corsivi sono miei).
Nel senso che l’autentica di una firma mi pare un fatto abbastanza “formale” e dunque mi chiedo cosa sia questa sorta di autenticità sostanziale che il decreto stabilisce. Interpretando per carità, mica innovando…
Come faranno i TAR a capire se è possibile desumere i dati necessari “in modo univoco” — come si chiede poche righe prima — quando non si legge (o proprio non c’è traccia di) chi/dove/quando ha autenticato una firma?
Detto ciò, Di Pietro che vuole valutare la richiesta di impeachment per Napolitano che ha firmato mi pare un’altra delle follie italiane, ma neppure capisco bene il senso di convocare una manifestazione per sabato prossimo (che mi pare sia, allo stato, la pensata del Pd).
