ma l’esperienza di pietro non dice niente a nessuno?

Ho sentito più volte il Pm De Magistris dichiarare che sia sua ferma intenzione continuare a fare il magistrato.
Rispetto al fatto che sia il candidato ideale della società civile avrei dei dubbi, se ancora si vogliono riconoscere le regole del nostro stato di diritto.
Mi pare che sia stato il CSM (Consiglio Superiore della Magistratura) a decidere sullo spostamento di sede e di funzione del PM.
E ricorderei che i membri del CSM sono in maggioranza magistrati eletti dai loro colleghi.
Per cui al posto di Donatone mi interrogherei sul fatto che il CSM, se ha preso provvedimenti così forti, considerata la sacralità del principio dell’inamovibilità dei magistrati, forse delle irregolarità le avrà pure registrate. O no?
Altrimenti bisogna concludere che il CSM complotta contro i magistrati ed emette decisioni immotivate.

Sono d’accordo con la webmasta e monica@. Totalmente. La scorciatoia giustizialista - al netto del rilievo di edoardo@ - è comunque impedimento alla crescita di una politica libera e responsabile. Non abbiamo imparato niente dai processi pomicino e gava? Dovevano rigenerare la politica? E eccoci con tre lustri di dirigismo statalista che ci ha portati alla rovina…Abbiamo già dato. Impegnamoci per un esito civile. E poi: basta con questa voglia di capuzielli, salvatori ed eroi. Un po’ di lavoro diffuso per fare cose buone, con reti di persone serie, senza l’ausilio del duce di turno - non è proprio pensabile?

Parliamo di due culture divrse e differenti, di due elaborazioni del pensiero oserei dire antitetiche. Monica portava l’esempio Di PIetro, io aggiungierei anche D’Ambrosio, la Parenti e, per restare nei nostri lidi, l’ondivago Miraglia del Giudice.

Se li vedo io, sono certo che li vedi anche tu e non vorrei che ci ritrovassimo da qui ad enne tempo, a dover ancora una volta recriminare su chi e come ha generato certi fenomeni tanto populistici, quanto deleteri per questa città.

penso che sia necessario stemperare il conflitto tra giudici e politici (anche per quello che si scriveva nel blog qualche giorno fa) e la scelta di De Magistris non mi pare la migliore.

guardate che roma e la toscana stanno per raggiungere la campania , tra poco pure loro non sapranno più dove mettere i rifiuti perchè come noi hanno saputo solo dire di no a tutto ,senza sviluppare progettualità sane ed ecosostenibili, hanno un pò di camorra in meno, ma qui il problema è più complessivo, è il modello di sviluppo consumistico e dilapidatorio del mondo in cui viviamo,da discutere, riparliamone !!!!
individuare una strategia complessiva di rinascita e di progresso economico che partendo dal basso spazzi via l’arroganza di chi sta ancora abbarbicato alle poltrone (ma perchè si deve dimetttere solo cuffaro ?), dopo aver mediato con tutto e tutti in campania (perciò stiamo a questo schifo) senza ammettere le proprie enormi responsabilità politiche (e forse penali ?) nel malgestire la pubblica amministrazione e l’enorme quantità di milioni di euro dilapidati.

per favore possiamo evitare che lo dica solo la destra, silenziosa e imbelle che ha avallato bassolino in questi lustri, possiamo evitare di annullare in massa le prossime schede elettorali dicendo che fanno tutti schifo, ci possiamo ridare qualche speranza, per aver il coraggio da adulti di dire qualcosa ai nostri giovani? facciamo qualcosa, scusate lo sfogo lungo

Gentile Presidente , il Parlamento di Strasburgo rimarca che non puo’ intervenire, fino a che Ella non risponde! E da quando si e’ insediato che siamo in attesa di risposta!Beato lei che crede nell’immortalita’ su questa terra!
Intanto l’Ucle ha diritto ad una Sua rispista in merito alla circostanza che Mastella abbia respinto alcuni giorni prima le ispezioni sull’operato di commissario straordinario del sisma D’Ambrosio Vito, per farsi difendere dallo stesso nel processo contro il Pm de Magistris! Dica si o no:il suo silenzio ed il resto e’ del demonio!
Lei, Presidente Napolitano, e’ velocissimo quando vuole intervenire :chiami il dottor Loris d’Ambrosio e tramite provvedimento disciplinare infici la sentenza di Selezione del 2006(per violazione parita’ presso Cassazione Lavoro ,ed in quanto Vito D’Ambrosio ha violato l’incompatibilita’ essendo controparte in altri processi per vicende terremoto). L’art.119 diritto comunitario,Trattato di Amsterdam e’ imperativo in ogni fase del processo ed irrinunciabile, anche se non fosse richiesto, ma fu richiesto fino allo spasimo! Non siamo europei per ingrassare o banchieri e multinazionali.Vogliamo che siana rispettate le leggi comunitarie!Quella della parita’ e’ imperativa , irrinunciabile in ogni grado. La principessa Yasmin von Hohenstaufen ha inviato un esposto al Presidente CSM Napolitano, per legittimo sospetto di favoreggiamento di ambienti politico-mafioso giudiziari lametini, da parte delMinistro Mastella , piu’ volte sollecitato ad ispezioni sia presso il Tribunale civile di CZ che Tribunale civile di Lametia Terme . Il ministro Mastella non ha inteso , dare corso alle richieste di ispezione al Tribunale civile Lametia e tribunale fallimentare , si presume in quanto la proprieta’ di Video Lametia 7 ,Ing Francesco Grandinetti imprenditore possa avere interessi i con certo Antonio Saladino :tra l’altro due nomi identici appaiono nel consiglio comunale di Lametia (europress)

Si ha da presumere ,scrissero i legali ( altrimenti non potevano dire) che” trattandosi di territorio ad alto rischio, alcuna garanzia vi sia stata nella vicenda che offende lo stesso decoro delle istituzioni giudiziarie” .Ed ecco cosa scrivono i giudici che , dopo venti anni smontano una sentenza di un giudice coraggioso come Bruno Porcelli e rinfacciano alla top Manager Yasmin von Hohenstaufen, che protestava per la lungaggine di ventanni solo per il primo grado, che a causa del suo deprecabile contegno processuale, e’ condannata a pagare il legale della controparte , certo avv Palamara (questo nome ricorda qualcosa…)con la somma di circa 12 mila euro! Giustizia Lametina e’ stata fatta !… Mastella permettendo che ha rigettato la richiesta di ispezione! Tutti i nostri giudizi li omettiamo, a parlare e’ la registrazione Ucle del padre del Presidente del Tribunale di Lametia ,che svelava, sin da 92, alla top Manager ,connessioni tra la imprenditoria mafiosa e alcuni magistrati lametini ! ”

Con telegramma del 7.5.07 n.063/Ag, la segreteria legale della principessa von Hohenstaufen , sollecitando al Ministro Mastella ,nuovamente ispezione sull’operato del Tribunale civile di Lametia Terme , tanto eccepiva, per conoscenza al Tribunale Civile di Lametia:”Rigettasi in toto prosciolta riserva 27.3.07 trib fallimentare reg.gen. 2091/2004 contro VL7/5 stelle - Lametia Terme, per omessa ricusazione in corso dal 21.3.o7 , per i motivi di cui alla richiesta ispezione , come ribadito da telegramma 26.03.07.Si puntualizza che invocare ispezioni e lamentare lungaggine ultreventennale processo lavoro , solo primo grado, presso ministro giustizia e CSM e’ perfettamente legittimo e non offensivo. Semmai ad offendere sentenza passata in giudicato di un magistrato illuminato e competente come il dr. Bruno Porcelli di Lametia Terme ,disattesa dopo sette anni in cui si e’ dato tempo alla controparte di fallire, e’ proprio l’estensore della prosciolta riserva (tribunale fallimentareVL7), in quanto , non solo ha destabilizzato norme giuridiche Codice civile e Cida Findai su cui fu steso il contratto , in ambito manuale dirigente Buffetti in vigore 88/89 e contratto triennale poi rinnovato di Manager come da norma 230 art.4.1. -18.4.62.

I giudici se fossero stati in buona fede, avrebbero dovuto, almeno , per scrupolo, rivolgersi ad un perito cida in merito identikit del Manager . Nonostante sentenza passata in giudicato dell’illuminato Magistrato dr Bruno Porcelli di Lametia Terme n.437/2000 ruolo 5.12.89 che riconosce che la prof dr.Yasmin von Hohenstaufen , gia’ presidente di multinazionale americana,per oltre 10 anni, giornalista e docente universitaria , presidente UTE Unioni Televisioni Europee, effettivamente era stata General Manager della VL7 cinque stelle , cui aveva procacciato profitti inimmaginabili ,attraverso strategie da evolutionary management , ed il passepartout della sua credibilita’ personale!

Per quanto concerne la richiesta di ispezione Tribunale civile Lavoro Lametia Terme esso riguardava una serie di abusi giudiziari , in ambito di legittimo sospetto politico mafioso lametino che non consentiva il corretto svolgersi di processo di Lavoro.La causa era cominciata nel 1989 anche se , stranamente e’ giunta ,notifica tempestiva odierna ai legali ,dell’esito ,nella giornata odierna dopo la pubblicazione su Kataweb della notizia, che e’ stata subito rimossa , ma risulta su google.

Dove sono finiti i duemiliardi del Castello Hohentaufen?La Regione Marche non risponde!

Il consiglio di Stato da’ ragione alla professoressa Yasmin Aprile von Hohenstaufen Puoti Canmore , proprietaria del Castello Hohenstaufen di Alfi Fiordimonte :le decisioni del Com,Cts e regione Marche erano meri episodi endoprocessuali e non irrevocabili prescritte decisioni di diniego delle sue richieste legittime, quindi e’ inammissibile persino l’impugnazione da parte della principessa Yasmin , in quanto non poteva impugnare atti assolutamente inefficaci e nulli!
Una giovane avvocatessa Lia Giuliodori di Osimo , vince la sua tesi contro la protezione civile, e la regione Marche!

La sentenza della prima sezione Consiglio di Stato 4248/o7 del 13 febbraio o8 , prof Yasmin Aprile von Hohenstaufen , relatore Giudice Siracusa ,da cui emerge che tutti i fatti ratificati quali corretti e irrevocabili, sono mere vicende endoprocessuali, non definitive e pertanto ,aver giudicato corretto l’operato del CTS ,non rappresenta un passato in giudicato irrevocabile, essendo mero parere, suscettibile sia di critiche che di confronto e revisione e revoca.In realta’la Regione Marche , proprio dal falso presupposto che l’operato del CTS sia indiscutibile e definitivo, ha fatto partire una raffica di rappresaglie e addirittura denunce di diffamazione ,fino a provocare un giusto risentimeno per la grave ingiustizia imposta, mentre trattavasi di meri pareri , peraltro espressi in maniera e formalita’ scorrette, su inadempienze, omissioni, travisamento, procedure errate.
La regione Marche, dunque , su meri pareri endoprocessuali ha ratificato il comportamento anomalo , negligente, inadempiente, omissivo , travisato del Com e CTS e della stessa Regione Marche . Dunque su presupposti falsi , si voleva e legiferare e punire chi ha smentito la proclamata stabilita’ del Castello Hohenstaufen, attraverso i VVFF che hanno emanato decreto di pericolosita’ totale il 5 ott.o7, contro la Regione che ha avallato sopralluoghi nulli dell’Ing Spuri, ove non si e’consentito la presenza del perito di parte e quando c’era si sono rifiutati di verbalizzare le controdeduzioni.Infatti solo ad un mese di distanza della reiterata decretazione di conformita’ dei lavori e di correttezza operato e stabilita’ , i vigili del fuoco invocati dalla proprieta’ hanno emanato decreto totale di pericolosita’, dopo dieci anni dal loro scriteriato operato!Oggetto del ricorso al CTS era omissione inadempienza pericolosita’ verso terzi, relativamente a muraglia edifici sulla strada , colonne, chiesa rimessa come da schede GNDT, disattese dal Com e Comune.I livelli danni fabb.81 arbitrarei in quanto, come afferma lo stesso Ordine Ingg. Arch, di Mc ed il perito di parte sono stati esclusi interrati seminterrati , sottotetti e protocolli antisismici della 61/98 che non prevedeva essi livelli , ma che il contributo fosse finalizzaro all’ottenimento ,agibilita’, stabilita’, sicurezza, abitabilita’.Lo stesso Direttore del lavoro Di Loreto denuncia sperequazione ed abbassamento livelli, tramite pressioni indebite . Infatti il contributo ,da 600 milioni sul fabbr.81, e’ stato decurtato a 73 mila euro. Il perito Arch Pelliccioni denuncia ,come da controperizie ,inerzia totale ed omissioni della REGIONE MARCHE , NONOSTANTE MIGLIAIA DI DENUNCE E SOLLECITI omessi Puntellamenti interni ed esterni per otto anni castello porz.80, arbitrariamente estrapolato, come ammette nel prot.99 /07 il Comune di Fiordimone , dalla Regione Marche.Violazione unicum 80/81, ratificata anche dal perito del Tribunale di Palestrina ,Arch Bausano .Arbitraria revoca residenza per rappresaglia, tramite uno stampatello apocrifo atribuito ad un impiegato del comune morto.Decade quindi la ratifica di D’Ambrosio sull’operato del CTS, che addirittura lo spinse a querelare di diffamazione chi protestava ;nulla la risposta del Direttore della Regione Marche Mario Conti che pretendeva che l’inerzia del Com , Comune e Cts fosse oggetto di impugnazione, mentre trattavasi di mero fatto endoprocessuale e pertanto anche la multa inflitta alla proprieta’ e’ atto arbitrareo ,in quanto il comune ha violato l’ordinanza pericolosita’ verso terzi e deve adempiere a tutti gli oneri di sua competenza. Nulla l’estrapolazione dell’80/81 , in quanto errore della Regione , mentre la circostanza che il CTS lo abbia ratificato e’ fatto endoprocessuale criticabile e revocabile,cosi’ come la revocazione illegittima residenza.
